This page states the "Terms of Use" under which you may use this website, which is an interactive online service operated by Psychly ("we", "us", "our"), consisting of information services and content provided by us and other third parties (the "Site"). These Terms of Use include the Site Privacy Policy and form a binding agreement between you and Psychly. Your access to or use of the Site indicates your acceptance of these Terms of Use.
1. Acceptable Use
This Site is intended to provide users of legal age with general information and resources related to connecting with qualified psychedelic therapy providers. We do not directly provide any therapy services or guarantee outcomes. Psychly does not recommend or endorse any specific professionals, treatments, tests, products, procedures, opinions, or other information that may be mentioned on the Site. Reliance on any information provided by us, our employees, others appearing on the Site at our invitation, or other visitors to the Site is solely at your own risk. Your use of the Site is a privilege. The Site may not be used for any illegal activities related to controlled substances.
2. Rules of Conduct
We are the sole interpreter of the Site rules of conduct described in these Terms of Use. Users who violate these rules may have their access and use of the Site suspended or terminated at our discretion. We may at any time take any action with regard to user materials that we deem in our sole discretion to be necessary or appropriate.
a. Posting Rules
i. Materials you post to the Site may not contain:
- URLs or links to websites that compete with the Site.
- Copyrighted material (unless you own the copyright or have the owner's permission to post the copyrighted material).
- Trade secrets (unless you own them or have the owner's permission to post them).
- Material that infringes on or misappropriates any other intellectual property rights or violates the privacy or publicity rights of others.
- Anything that is sexually explicit, obscene, libelous, defamatory, threatening, harassing, abusive, or hateful.
- Anything that is embarrassing or offensive to another person, group, or entity.
- Information related to sourcing or acquiring controlled substances.
ii. You may not use your Materials to:
- Impersonate another person, living or dead.
- Post false, inaccurate, or misleading information.
- Imply specific endorsement by us.
- Post advertisements or solicitations of business (including, but not limited to, franchises, "club memberships," distributorships, or anything requiring a monetary investment, including a request for payment to obtain job listings).
- Post chain letters or pyramid schemes.
- Post opinions or notices, commercial or otherwise.
iii. Materials that encourage our users to "email for more details" are not permitted. Materials from any third party charging a fee are not permitted.
iv. We are under no obligation to monitor the materials posted on the Site by users, but we may monitor materials at random. Any materials we find in our discretion to violate these Terms of Use may be removed. If we are notified by a user that any user materials on the Site violate these rules, we may investigate and determine in good faith whether we agree with such allegation, in which case we may remove or request the removal of user materials. We are not required to make any such investigation or to remove any user materials, and we will not be liable to any user for taking or not taking such actions.
b. Conduct Rules
i. You may not respond to postings by other users in any manner or for any purpose other than that which is expected. Responses soliciting business are prohibited.
ii. You may not send (or encourage or help others to send) unsolicited commercial email to our users.
iii. Report inappropriate postings or conduct to a Psychly team member.
iv. You may not delete or revise any material posted by any other person or entity.
v. Any conduct by a user that in our sole discretion restricts or inhibits any other user from using or enjoying the Site is prohibited.
vi. We are under no obligation to monitor the conduct of our users, but we may investigate and respond when violations are reported.
c. Security Rules
i. Users are prohibited from violating or attempting to violate the security of the Site, including, without limitation:
- Accessing data not intended for such user or logging into a server or account which the user is not authorized to access.
- Attempting to probe, scan, or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization.
- Attempting to interfere with service to any user, host, or network, including, without limitation, via means of submitting a virus to the Site, overloading, "flooding," "mailbombing," or "crashing."
- Sending unsolicited email, including promotions and/or advertising of products or services.
- Forging any TCP/IP packet header or any part of the header information in any email or newsgroup posting.
ii. Violations of system or network security may result in civil or criminal liability. We will investigate occurrences that may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.
3. User Passwords and Security
You are responsible for maintaining the confidentiality of your password and site usage. You agree to immediately notify us of any unauthorized use of your password or username or any other breach of security. You may be held liable for losses incurred by us or any other user of the Site due to someone else using your username or password. You may not use anyone else's username or password at any time. We cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.
4. Therapist Screening and Verification
Psychly does not make any representations or warranties about the accuracy, reliability, completeness, or timeliness of the information provided by the listed therapists. It is the user's responsibility to independently verify a therapist's qualifications, credentials, and suitability before engaging their services. Psychly shall not be liable for any loss or damage caused by a user's reliance on information obtained through the Site.
5. Limitation of Liability
In no event shall Psychly, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (i) errors, mistakes, or inaccuracies of content, (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our Site, (iii) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (iv) any interruption or cessation of transmission to or from our Site, (iv) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our Site by any third party, and/or (v) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the Site, whether based on warranty, contract, tort, or any other legal theory, and whether or not the company is advised of the possibility of such damages.
6. Indemnification
You agree to defend, indemnify and hold harmless Psychly, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Site; (ii) your violation of any term of these Terms of Use; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party. This defense and indemnification obligation will survive these Terms of Use and your use of the Site.
7. Changes to Terms of Use
We reserve the right, at our sole discretion, to modify or replace these Terms of Use at any time. By continuing to access or use our Site after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Site.
